摘要：为巩固“基本解决执行难”成果，向切实解决执行难迈进，湖州市中级人民法院将标准化作为执行长效机制建设的抓手和关键，于2018年9月委托湖州市质量技术监督局制定《执行工作流程管理规范》，以标准化推进规范化。为推进该地方标准的实施，客观准确评估湖州两级法院新的执行工作机制及其成效，受湖州市中级人民法院委托，中国社会科学院国家法治指数研究中心、中国社会科学院法学研究所法治指数创新工程项目组开展湖州法院执行规范化指数评估。

评估结果显示，湖州法院执行办案规范度明显提升，具体体现为：保全及时，源头缓解执行压力；确保信息准确，提升数据质量；线上查控及时，保障执行效率；强化执行措施，提高执行效果；部分法院重视财产申报制度；涉案财产处置变现规范高效；执行款管理规范、发放及时；协同执行整合湖州区域资源。湖州市中级人民法院的地方标准为全国建立统一的执行行业标准提供了样本。湖州法院在规范执行的过程中，也存在约谈当事人有待加强、终本案件线下调查比较薄弱、拒不申报制裁力度仍显不够、执行流程标准有待统一等问题。这些问题在全国具有普遍性，因此加强顶层设计、统一执行标准势在必行：树立和强化规范执行理念；碎片化执行规范亟待整合；强化法院系统内部衔接机制；推广和完善询价议价机制；适当放宽终本的适用范围；完善“拒执罪”的制度设计；加强对规避执行的深度调研；尝试建立差异化执行模式；建立科学的执行考核体系；依托信息化实现执行规范化。

Abstract: In order to consolidate the achievements made in overcoming enforcement difficulties and effective solve the problem of enforcement difficulties and taking standardization as the key to the construction of a long-term enforcement mechanism,the Intermediate People's Court of Huzhou Municipality,Zhejiang Province entrusted the Quality and Technology Supervision Bureau of Huzhou Municipality to formulate the Standard onManagement of Enforcement Process in September 2018.To promote the implementation of this lo cal standard by two levels of courts in Huzhou Municipality and objectively and accurately evaluate the operation of the new enforcement mechanism and its results,the CASS Center for National Rule of Law Indices and the Innovation Project Team on the Rule of Law Indices of CASS Law Institute were entrusted by the Intermediate People's Court of Huzhou Municipality to carry out assessment of the index of standardization of court enforcement in Huzhou.

The assessment shows that there has been a marked rise in the level of standardization of the handling of enforcement cases by courts in Huzhou in 2019,the concrete manifestations of which include: adopting timely preservation measures to relieve enforcement pressure at its sources；ensuring the accuracy of information to improve the quality of data; conducting timely online inquiry and control of properties to raise the efficiency of enforcement; strengthening enforcement measures to enhance the effect of enforcement; and attaching importance to the property declaration system,standardizing and raising the efficiency of disposal and realization of disputed properties,ensuring the standardized management and timely payment of enforcement money,and integrating regional resources and coordinating enforcement actions.The lo cal standard adopted by the Intermediate People's Court of Huzhou Municipality provides an example for the establishment of a unified professional enforcement standard in the whole country.In the process of standardizing enforcement,courts in Huzhou have encountered such problems as unsatisfactory interviews of parties,weak offline investigation of cases with terminated enforcement procedures,apparently insufficient punishment of refusal to declare property,and lack of unification of standard on enforcement procedure.All these problems are of universal nature in the whole country.Therefore,it is imperative for China to strengthen top-level design and unify enforcement standards,establish and strengthen the idea of standardized enforcement,integrate fragmented enforce ment norms,strengthen the internal linkage mechanism within the court system,popularize and improve the inquiry and bargaining mechanism,appropriately widen the scope of application of termination of enforcement,improve the institutional design of the crime of refusing to satisfy judgment,strengthen in-depth investigation and research on the evasion of enforcement,create a differential enforcement mode,establish a scientific enforcement assessment system,and rely on information to realize the standardization of enforcement.
